Statement of Issue:
The Huntington Beach Fire Department is seeking City Council approval of the attached resolution acknowledging receipt of their report regarding the annual inspection of certain occupancies as mandated by the State of California. This resolution will be submitted to the State of California in compliance with State Senate Bill 1205.

Adopt Resolution No. 2022-36: "A Resolution of the City Council of the City of Huntington Beach Acknowledging Receipt of a Report Made by the Fire Chief of the Huntington Beach Fire Department Regarding the Inspection of Certain Occupancies Required to Perform Annual Inspections in Such Occupancies Pursuant to Sections 13146.2 and 13146.3 of the California Health and Safety Code."

Alternative Action(s):

Analysis:
The State legislature requires the chief of every fire department to conduct annual inspections on every public or private schools, hotel, motel, lodging house, apartment house, and certain residential care facilities (Health and Safety Code 13146.3, 13146.2, 17921(b)).
Beginning on January 1, 2019, every fire department must report on these State mandated annual inspections (Health and Safety Code 13146.4, Added by Stats. 2018, Ch. 854, Sec. 1. (SB 1205) Effective January 1, 2019). The City Council must acknowledge receipt of the report in the form of a resolution or other formal document.
