Statement of Issue:

On May 3, 2022, bids were received for Gothard Restroom Improvements Project CC-1628.  City Council action is requested to award the construction contract to Horizons Construction Company (Horizons), the lowest responsive and responsible bidder.

 

Financial Impact:

Horizon’s bid is in the amount of $470,219, and sufficient funds for this project are budgeted within the FY 21/22 Capital Improvement Program (CIP).  The recommended action advances $640,751.95 of approved funds from account 22645010.82900 ($402,555), 22845028.82900 ($168,496), and 31440001.82900 ($69,701) to fund the project.  This funding includes Horizon’s construction contract bid amount, construction management and inspection, supplementals, and fifteen percent (15%) construction contingency.

 

Recommended Action:

A)  Accept the lowest responsive and responsible bid submitted by Horizons Construction Company in the amount of $470,219.00; and,

 

B)  Authorize the Mayor and City Clerk to execute a construction contract in a form approved by the City Attorney; and,

 

C)  Authorize the Director of Public Works to execute change orders not to exceed a total of 15%.

Analysis:

The CIP proposes rehabilitation of the existing restroom building located in Central Park. Interior improvements include the remodel of existing restrooms to create 2 unisex ADA restrooms and 2 non-ADA unisex restrooms. Structural improvements include repairs to the existing building structural components that have corroded due to water damage. Other improvements include interior and exterior painting, metal railing, exhaust fans and epoxy floor finish.

 

Bids were received on May 3, 2022 with the following results:

The apparent lowest bid was submitted by Elegant Construction Inc. However, on May 14, 2022, Elegant Construction Inc. submitted a Letter of Withdrawal due to an error on their bid sheet and has resulted in their bid to be deemed nonresponsive. Staff therefore recommends awarding a construction contract to Horizons Construction Company in the amount of $470,219.00. The total project cost is estimated to be $640,751.95, which includes the construction contract bid amount above, construction management and inspection, supplementals, and fifteen percent (15%) construction contingency.

 

Public Works Commission Action:

The Public Works Commission reviewed and approved CC-1628 on April 20, 2022.

 

Environmental Status:

The project is categorically exempt pursuant to Class 1, section 15031d of the California Environmental Quality Act.
