1. Does the proposed Capital Improvements Program (CIP) for fiscal year 2021/2022 conform to the goals and policies of the General Plan?

A)                     Find the proposed project categorically exempt from the California Environmental Quality Act pursuant to Section 15306.

 

B)                     Adopt Resolution No. 1718 approving General Plan Conformance No. 21-001 (Attachment No. 1).

PROJECT PROPOSAL:

 

Section 65401 of the California Government Code requires that a local planning agency review a list of proposed projects recommended for planning, initiation, or construction during the ensuing fiscal year for conformance with the local General Plan.  This list of proposed projects is contained in the CIP submitted by the Public Works Department for fiscal year 2021/2022 (Attachment No. 1, Exhibit A).  The role of the Planning Commission in reviewing a CIP is to ensure the conformity of each project with the goals and policies of the General Plan.  The City Council will then review and act on the  benefits and funding source of individual projects listed in the CIP.

 

ISSUES AND ANALYSIS:

 

General Plan Conformance:

Exhibit A of Resolution No. 1718 (Attachment No. 1) outlines the proposed CIP for fiscal year 2021/2022 and the relevant General Plan goals and policies.

Environmental Status:

The General Plan Conformance review is categorically exempt pursuant to Section 15306, Class 6 of the California Environmental Quality Act (CEQA), which states that information collection that does not result in major disturbance to an environmental resource is exempt from environmental review.  Some projects identified in the CIP may require project specific CEQA review at the time they may be proposed.

Other Departments Concerns and Requirements:

The Public Works Department, acting as applicant for this General Plan Conformance, has reviewed and is processing the CIP through the City Council.

SUMMARY:

Staff has identified goals and policies that are applicable to the CIP in Exhibit A of Resolution No. 1718 (Attachment No. 1).  Because the proposed projects further the goals and policies of the General Plan, staff recommends the Planning Commission approve General Plan Conformance No. 21-001 finding that the CIP is in conformance with the General Plan.
