Statement of Issue:

Staff is requesting City Council to approve and authorize the Mayor and City Clerk to execute a License Agreement between the City of Huntington Beach and Southern California Edison for the purpose of retaining the current placement and position of existing traffic signal facilities located on Southern California Edison (SCE) owned property located on Center Avenue in Huntington Beach.

 

Financial Impact:

Over the proposed five years of this agreement, the City will pay to SCE a total of $1,105.13 to occupy SCE property for traffic signal purposes. The License Fee will begin upon the execution of this Agreement, with subsequent annual payments as per the schedule of rents below. Payments will be budgeted from 10085304.64620 Traffic Signal Maintenance Account. Under previous agreement the City has paid $250.00 per year for the same terms and conditions related to these facilities. These updated consideration terms show a decrease in city costs related to this agreement.

Approve and authorize the Mayor and City Clerk to execute a License Agreement between the City of Huntington Beach and Southern California Edison for use of property being occupied by City traffic signal facilities.

Alternative Action(s):

Do not approve the agreement and advise staff on steps to consult with SCE. This may result in the existing traffic lights being removed from their current locations on Center Avenue.

 

Analysis:

In 1993, the City installed traffic signals at the intersection of Center Avenue and One Park Plaza. A portion of these traffic signals are located on Southern California Edison (SCE) owned property. The parcels are identified as APN: 142-073-15 and APN: 142-073-16.

 

Over the years, the City has engaged in License Agreements with SCE to allow the traffic light facilities to occupy the property. The terms of these agreements vary, but have typically lasted for five years each. With regards to License Fees, the City paid $250.00 per year for the same terms and conditions in the previous agreement. This proposed agreement will allow for another five-year extension of the ongoing License Agreement.

 

The existing License Agreement has expired, and City Council approval is required for a new five-year agreement.  SCE has prepared a new License agreement, which has been approved by the City Attorney as well as the Public Works Department.

 

Environmental Status:

This action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
