STATEMENT OF ISSUE:
At the July 9, 2019 meeting, the Planning Commission forwarded to the City Council a recommended approval of three requests for consideration: 1) General Plan Amendment No. 19-001, 2) Zoning Map Amendment No. 18-001, and 3) Zoning Text Amendment No. 18-002. Zoning Text Amendment (ZTA) No. 18-002 is a request to modify three chapters of the HBZSO to establish new land use controls and development standards for the proposed Research and Technology (RT) zoning district.
The action taken by the Planning Commission to recommend approval of ZTA No. 18-002 did not and could not include any modifications to the HBZSO that affect the Industrial General (IG) or Industrial Limited (IL) zoning districts, as both the intent and public notice for the project were for the new Research and Technology (RT) zoning district only.
On Thursday, July 25, 2019, Commissioner Scandura submitted a request to review the changes made to the auto storage requirements of HBZSO Chapter 212 (Attachment 1).

PROJECT PROPOSAL:
Background:
The Planning Commission’s action is described in the July 10, 2019 Notice of Action and the legislative text language of HBZSO Chapter 212 Industrial Districts (Attachment 2). The language and changes included therein affect the standards and provisions for the new RT zone only, and the Commission’s action did not remove the existing requirements for existing Industrial districts.
As such, the 660-foot buffer for automobile dismantling, storage, and impound yard uses from any residential district remains in both the IG or IL districts. The Planning Commission action did not affect these standards, as the public hearing notice for ZTA No. 18-002 did not include changes to the IG or IL districts. The Planning Commission’s recommendation has been legally advertised for consideration by the City Council at an August 19, 2019 public hearing.
Commissioner Scandura requests to discuss the changes made on July 9, 2019 and determine whether they represent the intent of the Commission’s action.
Staff acknowledges that there has been some confusion regarding the zoning text amendment and applicability of standards to various vehicle storage type uses. Thus, staff intends to conduct further analysis of this subject and incorporation of the topic in a separate future code amendment project for Planning Commission consideration.
