PREPARED BY: Travis K. Hopkins, PE, Director of Public Works
Subject:
title
Adopt Resolution No. 2018-62 authorizing the Director of Public Works to execute Program Supplements to the California Department of Transportation Master Agreement for Transportation Projects
body
Statement of Issue:
The proposed resolution will authorize the Director of Public Works to execute Program Supplements to the California Department of Transportation (Caltrans) Master Agreement for federal-aid projects related to the Federal Highway Administration (FHWA) grant programs. Program Supplements are administrative actions that release approved grant funds for a specific federal-aid project.
Financial Impact:
The proposed agreement with Caltrans does not create a direct fiscal impact to the City. It defines the terms and requirements of obtaining State funding for transportation projects.
Recommended Action:
recommendation
Adopt Resolution No. 2018-62, “A Resolution of the City Council of the City of Huntington Beach Authorizing the Director of Public Works to Execute Program Supplements to the California Department of Transportation Master Agreement for Transportation Projects.”
end
Alternative Action(s):
Deny adoption of the resolution and jeopardize the grant funding for the City’s current and future federal-aid projects administered by Caltrans and direct staff how to proceed
Analysis:
In 1978, the City entered into Master Agreement No. 12-5181 with the State of California Department of Transportation (Caltrans), regarding the administration of the Federal Aid Program. Effective June 29, 1997, the Master Agreement was updated to include provisions of the Intermodal Surface Transportation Efficiency Act (ISTEA). The agreement was revised again and Master Agreement No. 12-5181R became effective on October 10, 2006. Most recently, the provisions of Master Agreement No. 12-5181F15 became effective on April 24, 2017.
The specific funding commitments for each federal-aid project take effect only after a project-specific Program Supplement to the Master Agreement has been fully executed by both the City and Caltrans. In an effort to facilitate this process, the City Council adopted Resolution No. 2010-29 on April 5, 2010, authorizing the Director of Public Works to execute all Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements, and/or Fund Transfer Agreements and any amendments thereto with Caltrans. Caltrans has requested that the City submit an updated resolution to reaffirm the authority granted to the Director of Public Works to execute all Master Agreements, Program Supplements, and other required documents as they relate to the administration of the City’s federal-aid projects.
