Statement of Issue:
On May 26, 2022, bids were received for the Florida-Georgia Water Main Replacement Project and Kiner-Gleada Water Main Improvement Project. City Council action is requested to award the construction contract to Orion Construction Corporation, the lowest responsive and responsible bidder.
Financial Impact:
Funding for this project in the amount of $2,955,150 is available in the Capital Improvement Program (CIP) budget. Cost of the project, including contingency, is estimated at $3,163,343. Funding to move the project forward (design, construction, etc.) is recommended as follows:

A) Appropriate $208,193 from the Water Master Plan Fund (507) to Account 50791006.82100, Water Improvement Fund; and,
B) Declare the first apparent lowest bid from CEM Construction, Inc. and second lowest bid from AID Builders, Inc., as non-responsive; and,
C) Accept the third lowest responsive and responsible bid submitted by Orion Construction Corporation, in the amount of $2,594,343; and,
D) Authorize the Mayor and City Clerk to execute a construction contract in a form approved by the City Attorney.

Analysis:
As part of the City’s Water Main Replacement Program per the 2016 Water Master Plan to annually replace old asbestos cement pipelines, the City identified Florida and Georgia Water Main Replacement Project (CC-1663) and Kiner-Gleada Water Main Improvement Project (CC-1664) for this fiscal year’s replacement.
The Florida-Georgia Project will replace approximately 1,300 lineal feet of 4-inch water facilities located in the alley west of Florida Street and another existing 4-inch water main in Georgia Street. These water facilities, constructed in 1950 and 1960 respectively, are undersized and require replacement. Since construction activities will likely further degrade the street pavement condition, this project will repave and grade the alleys to improve pre-existing drainage and aesthetics issues after construction of the water main. The proposed project will install 8-inch diameter pipelines to enhance the City’s water system redundancy and reliability and provide greater fire protection to the area.
The Kiner-Gleada Project will replace approximately 1,270 lineal feet of 6-inch water facilities constructed in 1956 and located along the parkway. The existing landscaping of enhanced pavers and trees installed above the water facilities has caused a persistent maintenance issue for Utilities staff and thus, the replacement waterline will be relocated. The proposed project will install 8-inch diameter pipelines in the street to facilitate efficient maintenance, access and increase fire protection. The existing street paving is in good condition and a slurry seal treatment will be applied to improve aesthetics after construction of the water main.

The apparent first and second lowest bids were submitted by CEM Construction Corporation and AID Builder, Inc., respectively. After a thorough review of the bids, staff recommends that these first two contractors’ bids be found non-responsive for not providing construction experience similar to the work required per the project specifications. Staff recommends award of the construction contract to the third apparent lowest bidder Orion Construction Corporation (Orion). Staff checked their experience and references and received acceptable responses from past clients, including the City’s positive experience working with Orion for a construction project that is currently underway. The City recommends award of a construction contract to Orion in the amount of $2,569,343. The estimated construction cost is $3,163,343, which includes the construction contract amount, a 10% contingency, and supplemental expenses, including contracted construction project management, and materials testing.
Environmental Status:
The project is categorically exempt pursuant to Section 15304 of California Environmental Quality Act.
