Statement of Issue:
Consider approval of Amendment No. 1 to the existing Cooperative Agreement, MA-080-23011516, between the City of Huntington Beach (City) and the Orange County Flood Control District (OCFCD). To clarify the roles and responsibilities, OCFCD, as the lead agency, submitted a Cooperative Agreement to the City. The cooperative agreement specifies funding, construction, and maintenance commitments between OCFCD and the City.
Financial Impact:
None. OCFCD is responsible for funding 100% of improvements related to the construction of the bridge flood walls in accordance with the contract documents. When OCFCD completes the project, the City is responsible for any post-construction maintenance within City right-of-way.

Alternative Action(s):
Deny approval of the Cooperative Agreement, which would result in stalling the project.
Analysis:
OCFCD identified that the Yorktown Avenue bridge over the Talbert Channel does not meet Federal Emergency Management Agency freeboard requirements, which is the minimum clearance between the bridge structure’s lowest elevation and the highest design flood water elevation in the channel. Flood walls are therefore required so that wave action or flow surges do not overtop the channel. OCFCD has completed the contract documents in order to construct these needed improvements.
OCFCD has prepared Amendment No. 1 to the existing Cooperative Agreement MA-080-23011516 for this project. The agreement specifies the responsibilities of each agency during the construction and post-construction phases. The existing agreement with OCFCD was for the funding, construction, and maintenance of the East Garden Grove-Wintersburg Channel (CO5) bridges at Warner Avenue, Springdale Street, and Edwards Street Bridges. Amendment No. 1 will include the addition of the bridge at Yorktown Avenue over the Talbert Channel. During construction, OCFCD will be responsible for all funding, inspections, project management, and all incidentals related to completing the construction of this project. Once construction is completed and accepted by the City and OCFCD, the City will assume responsibility for operation and maintenance.
Construction is expected to start in the Summer of 2024 and is anticipated to be completed by the fall of 2024.
Environmental Status:
The project lead is the OCFCD, and they have obtained all environmental approvals prior to the start of the project.
